Legislative Update - Week 3
CLAS hosted the first Hill Day on Tuesday, March 19. We had four participants. Our members met with Senator Donnie Chesteen and Representative Alan Baker about current education issues, and upcoming legislative issues. Three more Hill Days are scheduled. It was a three-day work week, meaning the House and Senate went into session Tuesday, Wednesday, and Thursday.
Bills Introduced and Added to CLAS Tracking:
- HB141 by Rep. Poole is the Education Budget, appropriations for the support, maintenance, and development of public education
- HB142 by Rep. Poole for Public education employees, 4% salary increase
- HB143 by Rep. Poole - Supplemental Appropriation for FY18 from the Education Trust Fund
- HB144 by Rep. Poole - Supplemental Appropriations for fiscal year ending September 30, 2018 from the Education Trust Fund Advancement and Technology Fund to various school systems and colleges and universities, and other entities.
- HB150 by Rep. Garrett - The bill would limit the service of members of the State Board of Education to two four-year terms of office and provide exception for existing members of the board.
- HB152 by Rep. Clouse - General Fund Budget, appropriations for other functions of government, debt service, and capital outlay for fiscal year ending September 30, 2020.
- HB159 by Rep. Lee - would reduce required number of restroom fixtures provided at public high school sport stadiums for each sex based on seating occupancy.
- HB183 by Rep. Scott – SSUT – would provide for update to the amnesty and class action provisions for eligible sellers and clarify transactions for which simplified sellers use tax cannot be collected and remitted.
- HB191 by Rep. Fridy - A constitutional amendment to provide that every parent has a fundamental right to direct the upbringing, education, care, and custody of his or her children.
- HB209 by Rep. Pettus - Qualifications to serve as school resource officer.
- HB216 by Rep. Faulkner – the bill would phase in the requirement that each public school in the state offer courses in computer science; provide funding for evidence-based, authentic computer science professional learning for K-12 computer science teachers; provide for a designated state computer science specialist at the State Department of Education; provide secondary and post-secondary graduation credit and admissions pathways in computer science for students; establish multiple computer science certification pathways for public school teachers.
- HB268 by Rep. Coleman would increase the population requirement from 5,000 to 15,000 for formation of a city school system, and require review by the SDE prior to that formation.
- SB116 by Sen. McClendon – The Alabama Lottery Act - creates the Alabama Lottery Corporation, authorizes distribution of revenues for college scholarships. Proceeds shall be split 50% to ETF and 50% to the State General Fund.
- SB125 by Sen. Ward – Juvenile Justice, provisions to the juvenile justice system substantially revised, adoption of policies for absenteeism and school misconduct required, Juvenile Justice Reinvestment Fund created.
- SB140 by Sen. Whatley – would revise the focus of the content, course materials, and instruction provided to public school students in any program or curriculum that includes sex education or the human reproductive process.
- SB149 – by Sen. Shelnutt - The EIRP is designed to be cost-neutral (i.e. it will not increase RSA’s unfunded liability or increase costs to RSA-participating employers) and therefore not as generous as the original DROP by making three changes:
- The old DROP provided that 100% of the member’s benefit would be paid into the DROP account. Under the EIRP, only 80% of the member’s benefit would be paid into the account.
- Second, under the old DROP, members could earn interest on their DROP accounts. Under EIRP, NO interest will be credited to the EIRP account.
- Third, under the old DROP, a member was entitled to a refund of his or her employee contributions made during the DROP participation period. Under the EIRP, there is no refund of employee contributions available.
- SB155 by Sen. Ward – Juvenile Justice, provisions to the juvenile justice system substantially revised, adoption of policies for absenteeism and school misconduct required, Juvenile Justice Reinvestment Fund created.
- HB32 by Rep. Boyd was carried over by call of the sponsor. The bill would name the self-administration law and the anaphylaxis preparedness program law together as the Kyle Graddy Act. This bill would specifically allow the possession and self-administration of single dose auto injectable epinephrine by a school student, also provide further for the definition of single dose auto injectable epinephrine.
Senate Education Policy
- SB14 by Sen. Melson that allows bible to be offered an elective in grades 6-12 was amended in committee. Amendments add that no teacher is required to teach, and no local board of education would incur liability due to provisions in the bill. The bill received a favorable report as amended. The bill was discussed on the Senate floor Thursday but was carried over.

Bill Passed in the Senate
- SB84 by Sen. Melson that requires the Alabama Commission on Higher Education (ACHE) to convene the deans of all the teacher education programs at the public and private higher education institutions in the state at least twice a year, and submit a report to the Governor, Speaker of the House, and President Pro Tem of the Senate regarding the status of education in the state and recommendation for changes in law, policy or practice. The bill received a favorable report and was passed by the Senate on Thursday. The bill has been introduced in the House and assigned to the House Education Policy committee.
The legislature will be on Spring Break March 25-29. There will be no legislative update Friday, March 29.
Convene Report - The House will convene Tuesday, April 2 at 1:00, and the Senate at 2:00 p.m. the same day.
